On September 17, 2008, Scott Binsack's briefs were accepted and filed in this matter (Case No.: 358 MDA 2009). The District Attorney's Office was ordered to have seven(7) copies of their answer/brief by October 15, 2009. Scott suspects that Maryann J. Grippo-Lackawanna County District Attorney and Corey Kolcharno-Lackawanna Assistant District Attorney will twist and alter their facts to substantiate their answers. To date, "both the Grippo and Kolcharno have done nothing but outwardly lied in their court appearances and in their answers to written motions and petitions," states Scott.
Additionally, Scott is now preparing a supplement to his brief, stating that even to this date that the lower courts and the Prothonotary's Office have refused to grant him copies of the December 16, 2008-serious court hearing- proving the shocking conduct by the now recused trial Judge Michael J. Barrasse, in order to perfect his brief. All attempts have coincidentally either been refused or denied and thus now derailed.
Futher, Scott will be filing a Petition to Consolidate this Case No.: 358 MDA 2009 with his PA Supreme Court Case No.: 682 MAL 2009, wherein for the PA Supreme Court to address both cases raise almost the same questions of relief at the same time.
